Contract for Wedding Photography
RESERVATION: A signed/submitted contract and deposit of $500 are required to reserve the date. The deposit will be applied toward the total wedding session fee. If the event is rescheduled, postponed, or cancelled, the deposit is non-refundable but transferrable to another session. The remaining balance is due two weeks before the wedding date or services will not be rendered.
EVENT SCHEDULE/ITINERARY: The client agrees to confirm the schedule no later than one week prior to the event. Notification of any changes in schedule or location must be made in a timely manner to ensure that the photographer has an accurate timeline of events.
EXCLUSIVITY: In order for the client to receive the best service and most compelling photos possible, the photographer must be the exclusive professional photographer for the wedding. Additional professional photographers may be employed only with prior written permission from the photographer. Guests photographing during the event are welcome with one caveat: the photographer will request your intervention if a guest is inhibiting the photographers ability to fully document your wedding. The photographer requires that no photographs are taken by guests, family members, or wedding party during the designated portrait time, as this distracts the couple and can detract from the quality of images.
LIMIT OF LIABILITY: Victoria Rose Photography will make every reasonable effort to provide outstanding images of the the client’s full desired shot list. The photographer is not responsible for compromised coverage due to causes beyond her control such as inclement weather, schedule complications, light restrictions, or lateness of the wedding party or family. In the unlikely event that the photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, global pandemic or other cause beyond her control, the photographer will make every effort to secure a skilled replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event. The entire liability of the photographer to the client for any claim or loss arising from her performance is limited to a refund to the client of the amount paid for services. The photographer does carry adequate backup equipment in preparation for the unlikely event of technical failure. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason beyond the photographer’s control. Liability for a partial loss of photographs shall be prorated based on the percentage of the total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by the client under this Agreement during the time preceding the date on which such liability arises. The photographer is not responsible for existing backgrounds or lighting conditions, which may negatively impact or restrict the photography coverage. While the photographer makes the best effort possible, she does not guarantee that everyone will be photographed, nor does she guarantee the exact number of images of any one person at the wedding, or the exact total picture count. Images determined by the photographer to be substandard or duplicated may be edited out. The photographer will use her professional judgment and sole discretion to select which photos to deliver.
ARCHIVAL: Upon receipt of the online gallery, the client accepts all responsibility for archiving and protecting the photographs. The photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read the images. It is client's responsibility to make sure that digital files are downloaded completely from their gallery within one year, after which photos will be removed to make room for new galleries. The photographer highly recommends that images are backed up in multiple locations and drives.
PERMISSIONS: It is the client’s responsibility to schedule and receive permission to use various locations for photography, including the wedding and reception locations and any other locations used during the day. It is also the client’s responsibility to make sure the photographer is aware of any restrictions enforced at these locations that would compromise her coverage.
MEAL: The client is required to provide the photographer and second shooter with meal accommodations as well as adequate time to complete their meal, which will generally take place after the couple and wedding party have been served, but before all guests to ensure time to eat before toasts, etc.
COVERAGE: . All hours of coverage booked must occur consecutively. No reimbursement or refunds will be given due to cancellation of any coverage on the contracted date. No partial reimbursements or refunds will be given if event ends earlier than contracted time or if client dismisses photographers early.
EDITING AND ARTISTIC STYLE: The client acknowledges that they are familiar with the photographer’s style and have reviewed her portfolio. The photographer cannot guarantee that the images resulting from the event will be identical or similar in style, interpretation or color to any current or previous portfolio examples; and that in creating the photos, the photographer shall use her personal artistic judgement to create images consistent with her personal vision of the event. The final post production and editing styles, effects, and overall look of the images are left to the discretion of the photographer. The photographer strives to maintain consistency in image quality and post-processing and will provide images of the highest possible quality and style. The photographer does not guarantee a minimum number of images that will be received by the client, but every effort will be made to provide images representing full coverage of the event and the persons involved therein. The photographer does NOT release any unedited or RAW images.
SERVICES: All photos will be edited in high resolution and delivered in an online gallery for download approximately 10-12 weeks of the wedding. Prints, albums, and other keepsakes may be added a la carte after the session is delivered. A preview of around 15 images will be delivered within one week. The photographer kindly requests
COPYRIGHT: The digital files and or prints produced by Victoria Rose Photography are protected by Copyright Law (all rights reserved). Editing (this includes any social media filters), cropping, or changing images in any way are forbidden and violate these copyright laws. It is agreed that Victoria Rose Photography may display and use the photographs taken for advertising, display, website and internet promotion, and any other promotions deemed fit. The client has full printing and use rights. We kindly ask that the client credits Victoria Rose Photography when sharing images online.
